1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and the operator of TheProfitPath ("TheProfitPath," "we," "us," or "our"). They govern your access to and use of our websites, applications, trading journal and analytics platform, content, AI features, community, support, integrations, and related services (collectively, the "Service").
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service for an organization, you represent that you have authority to bind that organization. In that case, "you" includes both you and the organization.
2. The Service
TheProfitPath provides tools that may include:
- manual, CSV, Notion, and connected-source trade journaling and synchronization;
- accounts, cash-flow ledgers, balance calculations, targets and risk-rule tracking, strategies, playbooks, backtesting, goals, emotions, analytics, statistics, reports, trade replay, and performance tracking;
- AI Tutor conversations, projects and chat organization, message feedback, chart-image analysis, personalized insights, automatic period reports and scoring, learning, evidence-assisted web research, and other generated content;
- live voice mode, in which you speak to the AI Tutor through your device microphone and hear a synthetic spoken reply;
- Market Monitor, including third-party charting embeds, market data, market news, economic-calendar information, and AI-generated market reports;
- community profiles, posts, stories, comments, direct messages including images, video, and GIFs, follows, shared achievements or trades, and mentor mode;
- image and video uploads, media playback, and sharing controls;
- safety, abuse-prevention, content-review, access-enforcement, audit, evidence-preservation, and appeal features;
- prop-firm, education, notification, referral, support, organization, status-page, and developer API features; and
- free, trial, or paid subscription features described at the time they are offered.
Features may vary by plan, region, device, or account and may be added, changed, limited, suspended, or discontinued. Descriptions on the Service are not a promise that a feature will always remain available.
3. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into these Terms. You may not use the Service if applicable law prohibits you from doing so or if we previously suspended you for violating these Terms.
You must provide accurate information, keep it current, and maintain only accounts you are authorized to use. You are responsible for activity under your account and organization, including activity through API keys, integrations, and users you authorize.
Account access is personal unless an organizational feature expressly allows multiple users. You may not sell, transfer, rent, or share account credentials. We may require email verification, two-factor authentication, identity confirmation, or other security steps.
4. Account Security
Keep your password, two-factor recovery codes, API keys, connected-service credentials, and devices secure. API keys may permit access to account data within their assigned scopes. You are responsible for reviewing sessions and integrations and promptly revoking access you no longer recognize or need.
Developer API: Requests made with your API key are treated as authorized activity under your account. Read-only and read/write keys can reach the documented journal, collaboration, notification, calendar, news, and eligible Market Monitor resources within their scopes, while separate plan, role, preview, rate-limit, and platform gates still apply. Give a key only to an application you trust, store it outside client-side code and URLs, and use exported personal or market data only as permitted by law, these Terms, the API documentation, and applicable third-party provider terms.
Notify us promptly through support if you suspect unauthorized use. We may disable credentials, sessions, integrations, or features where reasonably necessary to protect you, other users, or the Service. We are not responsible for loss caused by your failure to secure credentials, except to the extent applicable law provides otherwise.
5. Trading and Financial Risk
Important Trading Risk Notice
Trading involves substantial risk of loss and is not suitable for everyone. Past performance does not predict future results.
TheProfitPath is a journaling, education, analytics, and software tool—not an investment adviser, financial adviser, broker, dealer, exchange, custodian, tax adviser, or fiduciary. Nothing in the Service, including AI output, spoken replies in live voice mode, Market Monitor charts, market reports, detected levels or signals, analytics, reports, community content, mentor comments, notifications, news, or economic-calendar information, is financial, investment, legal, tax, or trading advice or a recommendation, solicitation, signal, guarantee, or offer to buy or sell any instrument.
Data may be delayed, incomplete, incorrectly imported, calculated using assumptions, or affected by outages and third-party errors. Simulated, demo, prop-firm, backtest, and hypothetical results have inherent limitations and may not reflect actual execution, liquidity, fees, slippage, taxes, or market conditions.
Market Monitor and market data: Charts, quotes, candles, and news shown in the Service come from third-party sources and charting embeds. They are not an execution feed, may be delayed or unavailable, may differ from your broker's prices, and must not be relied on for order entry, valuation, margin, or settlement. AI market reports are generated automatically, may be shared across users for the same instrument, are not tailored to you or your positions, and may be based on stale or incomplete data.
- You make every trading and financial decision independently and at your own risk.
- You must verify prices, calculations, rules, news, and AI output with primary sources before acting.
- You are solely responsible for broker, exchange, prop-firm, regulatory, reporting, and tax obligations.
- You should obtain advice from qualified, licensed professionals appropriate to your circumstances.
Never trade money you cannot afford to lose. TheProfitPath does not guarantee profitability, funding, payouts, improved performance, or any particular result.
6. AI Features
AI features may process your prompts, images, audio, conversation history, feedback, and relevant account, trade, journal, or market context through third-party AI providers. You authorize us and those providers to process that content as necessary to provide, secure, evaluate, and improve the features, as described in our Privacy Policy. Content you organize into projects or reference with an @ mention may be included as context for the responses you request. For research-backed answers, the Service may generate multiple search queries, retrieve and retain bounded public-source excerpts and provenance, evaluate the sufficiency of the evidence, and present citations.
AI output is probabilistic and may be inaccurate, incomplete, outdated, offensive, or unsuitable. It may not account for your complete history or circumstances. You must review output before using or sharing it and must not represent AI-generated content as independently verified.
Similar or identical output may be generated for other users. As between you and TheProfitPath, and to the extent permitted by law, you retain rights in your input and may use output generated specifically for you, but no right is granted in our software, prompts, models, product content, or third-party material contained in an output.
You may not use AI features to make fully automated decisions about another person that produce legal or similarly significant effects, to provide regulated professional advice without appropriate qualifications and review, or to generate unlawful, infringing, deceptive, abusive, or harmful content.
7. Live Voice Mode
Live voice mode captures audio from your device microphone while a call is active, converts it to text, and returns a synthetic spoken reply. Starting a call requires you to grant microphone permission in your browser, and you may end the call, mute the microphone, or withdraw that permission at any time. Audio is streamed through our real-time voice gateway and speech providers to produce a transcript and a reply; we do not retain the audio as a recording, and the resulting transcript is stored with your other AI conversations as described in our Privacy Policy.
Other people and your surroundings: You are responsible for the audio you transmit. Do not use live voice mode where the microphone will capture other people, confidential discussions, or protected information without the consent that applicable law requires. Recording and wiretapping laws vary by jurisdiction, and some require the consent of everyone present. Do not use the feature while operating a vehicle or in any situation where it would be unsafe or unlawful.
Voice characters, accents, and languages are synthetic outputs selected from options we offer. They do not represent a real person, are not the voice of any adviser, and must not be presented as a recording of a human being. Speech recognition may mishear symbols, numbers, prices, and names; a spoken reply carries the same limitations and disclaimers as any other AI output, and you must verify anything you intend to act on.
Voice mode depends on real-time network conditions, third-party capacity, and browser audio support. It may be interrupted, degraded, rate-limited, unavailable in some regions or on some devices, or discontinued. You may not use it to impersonate another person, to clone a voice, to transmit audio you are not authorized to transmit, or to generate content prohibited by these Terms.
8. Subscriptions, Billing, and Taxes
Some features require a paid subscription. Plan features, prices, billing interval, currency, trial terms, renewal date, and any limits shown at checkout form part of these Terms. Payments are processed by Stripe or another disclosed payment provider.
Automatic renewal: Unless stated otherwise or canceled before renewal, paid subscriptions automatically renew for the same billing interval, and you authorize the payment provider to charge the applicable price and taxes using your saved payment method.
Trials and promotions: Eligibility, duration, feature access, and conversion terms may vary. We may modify or withdraw a promotion where permitted by law. Coupons and referral benefits have no cash value, may not be transferred or combined unless stated, and may be revoked for error, fraud, abuse, or violation of their terms.
Referrals: Referral rewards, milestones, and cycles depend on the qualifying conditions stated in the program, and we may adjust, withhold, or reverse a reward for self-referral, duplicate or fraudulent accounts, chargebacks, or abuse. Where the Service lets you export details of people you referred, that export contains their personal information: you may use it only for your own record-keeping in connection with the program, must handle it in line with applicable privacy law, and must not sell it, publish it, add it to a marketing list, or use it to contact them without a lawful basis.
Cancellation: You may cancel through the subscription controls provided in the Service. Cancellation stops future renewals but normally takes effect at the end of the current paid period. Deleting the app, stopping use, or removing a payment method does not by itself cancel a subscription.
Refunds: Charges are non-refundable and unused time is not credited except where the checkout terms, our written refund policy, or applicable law requires otherwise. Mandatory cancellation, cooling-off, and refund rights remain unaffected.
We may change prices on advance notice, effective no earlier than your next renewal unless law permits otherwise. You are responsible for applicable taxes other than taxes on our income. If payment fails, we may retry the charge, downgrade access, or suspend paid features.
9. Your Content
"User Content" means information or material you submit, upload, import, create, share, or generate through the Service, including journal data, trades, notes, images, video, audio you speak into a voice call, prompts, messages, posts, comments, stories, profiles, strategies, projects, and feedback. You retain ownership of User Content you own.
You grant TheProfitPath a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, analyze, modify, and otherwise process User Content, and to sublicense those activities to our service providers, only as reasonably necessary to operate, secure, support, develop, and improve the Service and as described in our Privacy Policy. This license lasts while the content is stored by us and for a reasonable period afterward in backups, legal records, and de-identified materials.
For content you intentionally make public, you also grant us a license to display, distribute, and make that content available through the Service and allow other users to view, share, and interact with it through Service features. This public-content license ends when the content is deleted from active systems, except for copies previously made or shared by others and legally retained records.
You represent that you have all rights and permissions necessary to provide User Content and grant these licenses; that the content is accurate where accuracy matters; and that our permitted use will not violate law, contract, confidentiality, privacy, publicity, intellectual-property, or other rights.
10. Community, Sharing, and Mentor Mode
Public profiles, posts, comments, stories, shared trades, achievements, and shared AI links may be viewed, copied, indexed, or reshared. Direct messages are visible to participants but are not end-to-end encrypted. Do not post or send account credentials, private keys, confidential information, or personal information you do not have permission to share.
Media and shared trades: You are responsible for images, video, and GIFs you upload or send, including any people, screens, or third-party material they capture. GIFs offered in the message composer are supplied by third-party providers and are subject to their terms and content ratings. Where a feature lets you choose which trade fields are shown, review that selection before sharing; a field you leave visible is visible to everyone who can see the post, and copies already seen or saved by others cannot be recalled.
Badges, verification marks, and similar indicators reflect account or subscription status within the Service only. They are not an endorsement, a credential, a performance claim, or a statement that a user is qualified to advise anyone.
Mentor mode allows connected users to view certain journal, analytics, note, or performance information. A mentor is not our employee, agent, fiduciary, or endorsed adviser. You choose your connections and remain responsible for what you share and for independently evaluating any feedback.
We may review, restrict, remove, preserve, or disclose content and may suspend community features when we reasonably believe it violates these Terms, creates risk, or is necessary for support, moderation, security, or legal compliance. We are not obligated to monitor every interaction and do not endorse User Content.
11. Integrations, Imports, and Third-Party Data
You may connect or import from services such as Google, Notion, CSV sources, brokers, or other tools. You authorize us to access, copy, transform, and synchronize the data you select. You represent that you are authorized to access the source account and import its data.
Integrations and imports may duplicate, omit, misclassify, overwrite, or fail to update information. Review imported records before relying on them, maintain your own backups, and disconnect access you no longer need. We may impose file, request, storage, or synchronization limits.
Third-party products, websites, data, news, calendars, and integrations are controlled by their providers and governed by their terms. We do not guarantee their availability, accuracy, security, or continued compatibility and are not responsible for their independent acts or omissions.
Embedded third-party content: Parts of the Service, including Market Monitor charts, display content loaded directly from a third-party provider inside the page. That provider receives your request, may set its own cookies or storage, and controls what it shows, which instruments it will serve, and the terms and limits that apply to its content. Drawings, indicators, and settings you create inside an embedded chart belong to that provider's tool and may not be saved, synchronized, or recoverable through the Service.
12. Acceptable Use
You may not use the Service to:
- violate any law, regulation, court order, sanctions restriction, exchange rule, broker rule, or third-party agreement;
- facilitate fraud, market manipulation, deceptive promotion, impersonation, money laundering, or other harmful financial activity;
- infringe intellectual-property, privacy, publicity, confidentiality, consumer, or other rights;
- harass, threaten, exploit, discriminate against, stalk, dox, defame, or abuse another person;
- record, transmit, or transcribe another person's voice, image, screen, or conversation without the consent applicable law requires, or impersonate or clone any person's voice or likeness;
- upload malware, malicious instructions, unlawful content, or content designed to compromise a model or system;
- access another account, private content, system, or data without authorization;
- probe, scan, disrupt, overload, bypass, or interfere with security, authentication, rate limits, subscriptions, access controls, or normal operation;
- scrape, crawl, data-mine, benchmark, or use automated means to extract data or model output except through an authorized API and within its documentation and limits;
- reverse engineer, decompile, discover source code or model components, or create a competing service using protected elements, except where applicable law expressly permits;
- sell, sublicense, rent, timeshare, or commercially exploit access to the Service without our written permission;
- send spam, manipulate engagement, create deceptive accounts, or collect information about users without permission; or
- encourage, assist, or attempt any prohibited conduct.
We may investigate suspected violations, review relevant account activity and User Content, preserve evidence, and cooperate with lawful investigations. We may use automated signals, AI classifiers and adjudicators, deterministic security evidence, and authorized human review to identify and evaluate suspected abuse. These systems may make mistakes, and enforcement decisions may consider context, severity, confidence, evidence quality, risk, history, and legal requirements.
Depending on the circumstances and enabled platform controls, an enforcement may be applied automatically or by an authorized administrator and may include a warning, throttling, restriction of particular features, suspension, content removal, or permanent account ban. We may preserve encrypted evidence and tamper-evident decision, enforcement, custody, and audit records. If the Service provides an appeal option, you may submit an appeal for human review; submitting an appeal does not automatically pause or reverse an enforcement.
13. Our Intellectual Property
The Service, including its software, design, interfaces, databases, documentation, branding, logos, product content, prompts, compilations, and features, is owned by or licensed to TheProfitPath and protected by intellectual-property and other laws. User Content remains subject to Section 9.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. No other rights are granted by implication or otherwise.
14. Feedback
If you submit ideas, suggestions, bug reports, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate it without restriction or compensation. Do not submit feedback you are not authorized to provide.
15. Privacy
Our Privacy Policy explains how we handle personal information. You agree to use personal information obtained through the Service only for authorized purposes and in compliance with applicable privacy and data-protection law.
16. Copyright Complaints
If you believe content on the Service infringes your copyright, send a notice through our contact support page containing: identification of the work; identification and location of the allegedly infringing material; your contact information; a good-faith statement that the use is not authorized; a statement that the notice is accurate and that you are authorized to act; and your physical or electronic signature.
We may remove content and suspend repeat infringers where appropriate. Knowingly submitting a materially false notice may create liability. If a specific statutory notice procedure applies in your jurisdiction, your notice must meet that procedure.
17. Availability, Changes, and Beta Features
The Service may experience maintenance, delay, interruption, data-source failures, security events, or errors. We may change limits, eligibility, integrations, models, providers, or technical requirements and may suspend features where needed for security, legal compliance, provider changes, or business reasons.
Preview, beta, experimental, demo, and free features may be incomplete, changed without notice, and subject to additional limits. Some features are released first to a limited audience, such as an administrator preview, and may appear, change, or disappear for your account without notice. Do not rely on the Service as the only copy of important records; maintain independent backups and source statements.
Operational records: To operate, support, secure, and improve the Service, we keep records of how accounts use it, including pages opened, actions taken, and requests made. These records are used for troubleshooting, support, abuse prevention, and product improvement, may be reviewed by authorized staff, and are described in our Privacy Policy. They are operational records, not a monitoring service we provide to you or to any other user, and we do not make them available to other users.
18. Suspension, Termination, and Account Closure
You may stop using the Service at any time and may request account closure through support. Cancel paid subscriptions separately before renewal. Where available, export information you wish to keep before closing an account.
We may limit, suspend, or terminate access, remove content, or refuse service if we reasonably believe you violated these Terms, payment is overdue, your activity creates legal or security risk, a provider or law requires it, or continued operation is no longer commercially practical. Safety-related actions may be applied by an authorized administrator or automatically where configured and supported by the required evidence and confidence controls. Where appropriate, we will provide notice, an explanation, an opportunity to remedy the issue, or a secure appeal route.
An available appeal will be linked to the original case and preserved evidence and reviewed by an authorized person. An appeal does not guarantee restoration of access, and it does not stay an enforcement unless applicable law requires otherwise or we decide to do so.
After termination, your license to use the Service ends. We may delete or retain account information, including safety evidence and tamper-evident audit, decision, enforcement, custody, and appeal records, as described in the Privacy Policy and applicable law. Sections that by their nature should survive—including ownership, licenses, payment obligations, disclaimers, liability limits, indemnity, disputes, and general provisions—will survive.
19. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." TheProfitPath disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and warranties arising from course of dealing or usage of trade.
We do not warrant that:
- the Service will be uninterrupted, secure, error-free, or compatible with every device or provider;
- content, calculations, imports, market data, charts, AI output, speech recognition, synthesized speech, or community information will be accurate, complete, current, or suitable;
- data will never be lost, duplicated, corrupted, disclosed, or unavailable;
- defects will be corrected or third-party services will remain available; or
- the Service will produce any trading, financial, educational, or business result.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
20. Limitation of Liability
To the fullest extent permitted by law, TheProfitPath and its operators, affiliates, officers, employees, contractors, agents, licensors, and providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, revenue, goodwill, opportunities, data, or use, arising from or related to the Service or these Terms, even if advised that such damages were possible.
This exclusion includes trading losses; failed, delayed, or inaccurate imports; reliance on AI output, spoken replies, transcription errors, charts, market data, analytics, mentors, users, news, or third-party data; unauthorized account access; service interruption; and loss or corruption of User Content.
To the fullest extent permitted by law, our total aggregate liability for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid TheProfitPath for the Service during the 12 months before the event giving rise to liability or (b) US $100.
These limits do not exclude liability that cannot legally be excluded or limited, including mandatory consumer rights and liability for fraud, willful misconduct, or death or personal injury where applicable law so requires.
21. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless TheProfitPath and its operators, affiliates, officers, employees, contractors, and agents from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable professional fees arising from your User Content; your trading or commercial activity; your violation of these Terms or law; your misuse of the Service; or your infringement of another person's rights. We may control the defense of a covered claim, and you agree to cooperate. This section does not apply to the extent a claim was caused by our own unlawful conduct or where applicable consumer law prohibits it.
22. Disputes and Applicable Law
Before filing a formal claim, you and TheProfitPath agree to try to resolve the dispute in good faith. Send a written description through the contact support page. If the dispute is not resolved within 30 days after receipt, either party may pursue remedies available under applicable law.
These Terms are governed by the laws applicable to the operator of TheProfitPath, without regard to conflict-of-law rules. Courts with jurisdiction over that operator will have non-exclusive jurisdiction, except where mandatory law gives you the right to bring a claim elsewhere. If you are a consumer, nothing in these Terms deprives you of mandatory protections provided by the law of your country of residence.
To the extent permitted by applicable law, disputes must be brought on an individual basis and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. This restriction does not apply where applicable law makes it unenforceable.
23. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security, providers, or business practices. We will post revised Terms and update the date above. For material changes, we will provide additional notice when reasonably practicable or legally required.
Changes apply from the stated effective date. If you continue using the Service after that date, you accept the revised Terms. If you do not agree, you must stop using the Service and cancel any subscription. Changes will not retroactively reduce rights already accrued where prohibited by law.
24. General Terms
Entire agreement: These Terms, the Privacy Policy, checkout terms, and any additional terms presented for a specific feature are the entire agreement regarding the Service and supersede prior discussions about it.
Order and severability: Specific feature or checkout terms control only where they conflict with these Terms. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue in effect.
Waiver and assignment: A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, financing, merger, acquisition, sale, or transfer of the Service, subject to applicable law.
Force majeure: We are not responsible for delay or failure caused by events beyond our reasonable control, including internet or utility failures, provider outages, cyberattacks, natural disasters, labor disputes, war, civil unrest, epidemics, government action, or market closures.
No third-party beneficiaries: Except for parties entitled to indemnification or liability protection under these Terms, these Terms create no rights for third parties.
